 22.        The Contractor(s)/Labour Supply Mate(s) shall fell the trees in such a manner that the stumps of the felled trees should not be less than 10 cms. in height and should not be more than 25 cms in height without damaging or obliterating  matkingnumber and hammer mark on the trees. No chipping or uprooting of stumps shall be permitted. A penalty upto double the full royalty rates fixed by the Forest Department will be charged for excess volume left over in the stump. 

23.  The Contractor(s)/Labour Supply Mate(s) shall have to deploy sawyer in the first instance in respect of conversion works where timber is also to be extracted. The deployment of hakries labourers will be allowed only after the completion of sawing work. Inspection and approval of AM/SDM/DM deployment of hakries labour otherwise may result in termination of the contract at the risk and cost of Contractor(s)/Labour Supply Mate(s). 

24.      The conversion percentage/volume of sawn, axed, pulpwood, fuel wood and   charcoal etc. will be as shown in Annexure-B. If additional work of felling and conversion are allotted to the contractor /LSM, the conversion percentage (kind wise) for such additional work/volume will be fixed separately but it will not be less than out-turn percentage fixed earlier. In case volume as mentioned in annexure-B is not achieved penalty at following rate will be imposed for less extraction than that mentioned in Annexure-B:- 

Sawn = 1.50 times of rate offered.

Logs/Axed = 1.25 times of rate offered. 

      In case the Contractor(s)/Labour Supply Mate(s) may not be at fault to achieve the target shown in Annexure-B technically or based on the conditions of the marking, natural calamities or other circumstances beyond the control of Contractor(s)/Labour Supply Mate(s) he/they may apply for the approval of such variation to the Divisional Manager concerned during the course of extraction work. Director may approve the variation at his sole discretion on the basis of recommendations and report of the Divisional Manager based on his inspection of the work/lot during the tendency of work. 

25    .The specification for pulpwood, fuel wood  & Hakries will be as under :- 

Pulpwood:-   Pulpwood is to be extracted in  1 meter  length pieces in the following girth class out of chil/kail/fir and spruce and other suitable species as directed by the Divisional Manager:- 

a.      Girth above 60 cms.

b.      Girth 60 cms and below but above 25 cms.

c.       All pieces of pulpwood will be debarked. 

Fuelwood:-            All pieces of wood less than 25 cms girth and any length not more than 1 meter, Crooked, knotty and irregular pieces even above 25 cms in girth. Fuel wood is to be debarked.

            In case of Chil lots Contractor(s)/Labour Supply Mate(s) shall not extract the pulpwood, fuelwood and charcoal more than the quantity as prescribed in Annexure- B without the approval of Divisional Manager concerned. 

Hakries :-

            Standard size              : Girth above 85 cms.

            Under size                           : Girth between 60 cms to 85 cms.

            Non Standard size             : Girth below 60 cms. 

In no case under size hakries should exceed 10% of the total extraction & non-standard by________% of the total extraction. 

26    .The Contractor(s)/Labour Supply Mate(s) shall be responsible and liable to make good such loss for any avoidable damage cause to forest produce either on account of wrong working or his/their failure to carry out to instruction of the Divisional Manager or his authorized subordinates as may be issued in this behalf from time to time. 

27    .The labour supply mate(s) will employ throughout the period requisite strength of mazdoors as per directions of Divisional Manager. In the event of not maintaining the such strength of mazdoors by the Contractor(s)/Labour Supply Mate(s) on the work the Divisional Manager after having served the Contractor(s)/Labour Supply Mate(s) with a fifteen days notice to this effect may at his sole discretion constisticate part or whole of the dues and may employ additional workmen to complete part of whole of the remaining works specified in the schedule at the risk and cost of the Contractor(s)/Labour Supply Mate(s) and without prejudice to the claims of the State Forest Corporation. 

28    .In case the Contractor(s)/Labour Supply Mate(s) fails to complete the work during the stipulated period including the extended working period granted, if any, the security deposit will be forfeited to the HP State Forest Corporation and the work may be got done by the Divisional Manager at the risk and cost of the Contractor(s)/Labour Supply Mate(s) by employing other persons/labour or by re-allotment of the work to other Contractor(s)/Labour Supply Mate(s) so as to complete the work or any part thereof loss, if any, incurred to the HP State Forest Corporation on this account shall be recoverable from the Contractor(s)/Labour Supply Mate(s) as arrear of land revenue after adjusting his dues, excluding security deposits, with the Divisional Manager, if any. However, in case of gain, Contractor(s)/Labour Supply Mate(s) shall have no claim. 

29    .Trees, which are not found feasible for conversion into the timber, may be converted in fuel wood/charcoal/pulpwood as per directions of the Divisional Manager. 

30    .In the event of fire breaking out in the forest in which the successful tenderer, his agent/employees and labourers employed on such operation shall at once proceed to the seen of fire and shall do their best to extinguish or assist in extinguishing it. In case of fire breaking out in the forest due to sheer negligence on the part of successful tenderer(s) while carrying out his/their operations they/he will be held responsible for the damage thereof. 

31    .If successful tenderer fails to pay the dues of the labour(s) the Divisional Manager will be entitled to pay them from the dues of the tenderer(s). 

32    .That the final payment for the work by Contractor(s)/Labour Supply Mate(s) to the entire satisfaction of the Divisional Manager will be made within one month of the presentation of  complete bill on the basis of volume and classification of  destination depot records. 

33    .During the progress of work, Divisional Manager on the recommendation of Assistant Manager or any other authorized in this behalf by the Divisional Manager, from time to time, at his sole discretion, may make running payments not exceeding 80% of the value of the work done  EPF. 

34    .The payment for conversion of undersize timber/hakries will be made at half the rate of the standard size timber/ hakries. However, in case the conversion of undersize timber is/was due to the sheer negligence of the sawer, the same will be rejected and no payment shall be made and fine of Rs. 50/- per piece will be recovered. 

35    .The payment for “C” grade timber shall not be made at all. 

36    .The Contractor(s)/Labour Supply Mate(s) shall not leave any forest produce behind except as is not desired to be carried by the Divisional Manager or the officer duly authorized by him. If any converted or unconverted timber is left in the forest or  any stage before road side depot, the Contractor(s)/Labour Supply Mate(s) will be liable to pay compensation to the HPSFC Ltd: at the rate of Rs. 7000/- per cum. 

37    .No private timber or T.D timber obtained from any other source will be mixed with the stock of Forest Corporation. 

38    .Any dispute, difference or question which may at any time arise between the parties in respect of the works to be executed by the Contractor(s)/Labour Supply Mate(s) shall be referred for arbitration to the Managing Director H.P. State Forest Corporation Ltd; whose decision shall be final and binding on the both the parties. 

39    .The Court proceedings, if any connected with the works will be subject to the jurisdiction of Himachal Pradesh. 

40    .The Contractor(s)/Labour Supply Mate(s) will enroll himself/themselves for an independent EPF number of the Employees Provident Fund Scheme and will remit EPF of Labourers and his /their share to the EPF authorities, if payable. He/they will be responsible to send all returns regularly to the EPF authorities and copy thereof to the Divisional Manager. He/they will also provide a copy of roll-call register showing wages of labour every month to the Divisional Manager. In case of failure of remitting the EPF dues in time the Divisional Manager shall be competent to deduct the EPF dues from the work bills of the Contractor(s)/Labour Supply Mate(s). 

41    .The contractor(s)/Labour Supply Mate)s) and not the HP State Forest Corporation Limited shall be liable to pay any compensation to the labour employed by him/them under the workman compensation Act-VIII of 1923 and the rules framed there under  and also agrees /agree to bear all liabilities as a result of implication of labour law. However, the Forest Corporation has introduced Janta Personal Accident Policy to reduce the liabilities of compensation of Labour Supply Mate(s) as good will ligesture premium of the policy is borme by the Corporation in order to provide social security to the labour engaged by the Labour Supply Mate(s). Nevertheless, documentation for the claim shall have to be completed to the entire satisfaction of the Assurance Company by the Labour Supply Mate(s)/Contractor(s).  

42    .The Labour Supply Mate/Contractor shall procure Identity Cards from the office of District Employment Officer for all the labour being deployed in works. 

43    .The disbursement of wages to contract labour shall be made by the L.S.M./Contractor in the presence of Forest Guard or in  absence of Forest Guard, any other official so deployed by the Divisional Manager. 

44    The L.S.M./Contractor shall get all such labour deployed on works, medically checked up either through Health Department or by Private Medical Practitioner and produce such documents to the Divisional Manager or his authorized official on demand. 

45    .In case, the rates offered by the L.S.M. / tenderers are found lower, the earnest money will be raised as per detail given below which will be in addition to the earnest money already deposited by the lowest tenderer and will be deposited by the lowest tenderer within 7 days of the receipt of intimation for which the earnest money already deposited will be forfeited to the Corporation and fresh tenders will be called.  

1- Upto 14.99% being the approved upset price.                   Nil

2- 15% & upto 24.99%          -do-                                          Rs.10000/-

3- 25% and upto 29.99%      -do-                                           Rs.20000/-

4-30% and above                 -do-                                          Rs.30000/-
