13.3          The Director [North] may under exceptional circumstances and on application by the purchaser allow an extension in lifting timber/allied material subject to the payment of depot rent @3% per month on the pro-rata of unlifted Forest Produce. 

Failure to lift.

13.4          If the purchaser (s) fails/fail to lift the forest produce within the time as prescribed above, his/their security/earnest money and forest produce shall stand forfeited to the Corporation. 

Damage to Forest growth or any other property.

13.5          No damage shall be caused to the forest growth or any other property at the time of lifting the forest produce. For any damage the purchaser (s) shall have to pay damage/compensation, as may be assessed by the concerned Divisional Manager of the concerned Forest Working Division of Corporation to the owner of Forest Growth/Property. In case of dispute, the decision of the Director (South)/North/ Marketing shall be final and binding on the purchaser.

Restriction on sale etc.

14                No purchaser (s) shall sell the Forest Produce purchased by him/them to another party while such forest produce is lying in the Corporation depot. 

Condition for removal.

15                No forest produce shall be allowed to be removed from the sale depot without issue of a proper release order to be issued by the Divisional Manager of the concerned Forest Working Division as per Corporation rules and without the forest produce having been marked with export/sale hammer (wherever required) and accompanied by challan & documents required under rules. 

Arbitration.

16                In case of any dispute arising between the parties (viz. Corporation and purchaser) in respect of Forest Produce converted under these conditions of sale and auction thereof, the decision of the Managing Director, HP State Forest Corporation, Shimla to whom the case may be referred for arbitration by the parties shall be final and binding upon the parties.

17                The interpretation of these conditions by the Managing Director, HP State Forest Corporation, Shimla shall be final and binding on the parties. 

Jurisdiction.

18                Court proceedings, if any, connected with the sale shall be subject to the Jurisdiction of Himachal Pradesh Courts only. 

Agreement.

19                These conditions of sale shall be deemed as an agreement deed between the seller (HPSFC Ltd.) non one hand purchaser (s) on the other hand. 

AUCTIONING AUTHORITY. 

Certified that I/We have heard/red and understood the above conditions of sale in respect of Fuel wood/Pulp wood/Khair wood/Charcoal/Bamboo etc. to be put to auction/sale as announced on the day and time and place mentioned above and sign with my/our hand/hands as under in acceptance thereof and will abide by these: -
