CONDITIONS FOR THE AUCTION/SALE OF FUELWOOD/ PULPWOOD/ KHAIRWOOD/CHARCOAL BAMBOO ETC. LYING IN VARIOUS ROAD SIDE DEPOTS OF FOREST WORKING DIVISIONS OF H.P. STATE FOREST DEVELOPMENT CORPORATION LIMITED BEING HELD AT CENTRAL DEPOT NURPUR ON__________________

 DATE AND PLACE

This auction sale is being held on behalf of the H.P. State Forest Corporation hereinafter referred to as the Corporation for the sale of Fuel wood/Charcoal/Bamboo etc. hereinafter called Forest Produce at Central Depot Nurpur on this___ day of_________(Month). 200 

GENERAL CONDITION

2.1              The above forest produce is being auctioned on the basis of  “AS IT IS WHERE IT IS AND IN WHAT SO EVER CONDITION IT IS.” 

2.2              The bidder (s) shall be deemed to have inspected the forest produce/Lots. The bidder (s) accepts/accept as correct the No. Kind, measurement, weight, bundles, classifications and calculations of volume/weight etc. of forest produce put up for sale as given in the sale lists (s) and Forest Working Division’s record. Any clerical mistake in the sale lists will of course be corrected and payment will be due/received accordingly. 

2.3              In case any doubt in Khair lots (billets only), re-measurement can be requested within one week of auction on depositing 1% of the highest bid amount, If the variations are up to 3% in volume of the total billets in the whole lot, no change will be made in measurement and the amount of 1% deposited shall be forfeited. If this variation is more than 3% rebate/credit for the short fall in volume on the basis of volume auctioned in the lot shall be given and the amount of 1% deposited shall be refunded. 

2.4              The auction sale in Himkasth Sale Depots are subject to such restriction as may be imposed by the Government of H.P. from time to time. The purchaser is at liberty, either to utilize Khair wood (Billets) within the State or to export the same outside the State of HP after obtaining export permit from concerned DFO by paying prescribed export permit fee. However, fuel wood shall not be allowed to be exported outside the State of HP.  

AUTHORISATION TO BID

3                    The Auctioning Authority shall have the right to check whether any particular bidder is duly and property authorized by the firm for whom he is bidding and reserve the right to permit bidding or not by any individual/firm at his sole discretion. 

BID

4                    The bid shall be exclusive of all taxes. The taxation on sale of forest produce will be applicable as per H.P. Value Added Tax (VAT) Act, 2005 and Rule made there under instead of sales tax.

4.1              Income tax under section 4-AC read with section 206-C of income Tax Act would also be livable on sale of Forest Produce. 

4.2              The market fee @ 1% will also be charged from the successful bidder only on timber. 

DURATION OF BID

5                    Bid once offered shall remain open for 30 days from the date of auction. The auctioning authority/sanctioning authority without assigning any reason may not accept any final bid given at the time of the auction in which case the earnest money referred to in condition 8 shall be refunded forthwith.

6                    The auctioning authority reserves the right to withdraw, combine or split any lot(s) specified in the sale list(s). 

7                    ELIGIBILITY DEPOST

Amount of eligibility deposit

7.1              The intending bidder (s) is/are required to deposit a sum of Rs. 5,000/- or more at the discretion of the auctioning authority to become eligible for bidding in the auction/sale. Those who do not deposit this amount cannot participate in the auction/sale. 

Mode of payment

7.2              The eligibility deposit shall be paid in cash or in shape of Demand Draft in favour of concerned Forest Working Division. 

Adjustment.

7.3              The eligibility deposit may be adjusted towards earnest money due from a successful bidder (s) in whose favour the auction of lots(s)/Forest Produce has been concluded. 

Refund

7.4              The eligibility deposit shall be refunded to such bidder (s) who are not liable to deposit any earnest money. 

Forfeiture.

7.5              In case the highest bidder (s) resile (s) or withdraw (s) his/their bid before the period of 30 days stated in para-5 above, the eligibility deposit shall stand forfeited to the Corporation. 

7.6              The highest bidder (s) who resile (s) from the bid offered shall not be permitted to participate and bid in the resale of that lot or part thereof. Further, the auction authority will be at discretion not to permit such bidder (s) to participate in subsequent auctions.
